In a recent decade, we often hear some terms, like vegan skincare, clean beauty, or cruelty free, when we shop at some beauty boutiques. What are they? What are the differences among three terms? 

Vegan skincare

Vegan skincare means that the beauty products are produced with plant-based ingredients, without any ingredients derived from animals, including animal by-products. Although vegan skincare does not have any animal derived from animal, it may be tested on animal during the product development. There are many benefits of using vegan skincare. Firstly, it is a good news to animal. Vegan skincare products generally contain less ingredients which are likely to irritate the user’s skin. 

Cruelty free

Cruelty free means that the beauty products are created without being tested on any animals. Cruelty free products may contain animal ingredients. 

Whether The Beauty Products Being Sold in China Are Still Cruelty Free

China has an Animal Testing requirement (according to The Cosmetic Supervision and Administration Regulation, CSAR) for all beauty brands, which intend to sell their products in the mainland China, including both vegan beauty products and non-vegan beauty products although there have been a few adjustments on some exemption of pre-market animal testing on 1st May 2021. In fact, animal testing requirement for the skincare and cosmetic brands is not banned in the mainland China. The latest regulation allow companies to market their products without animal testing if they take certain procedural steps and qualify for an exemption. Therefore, the brands that have paid for animal testing in China are not considered as cruelty-free. They are still doing something to harm animals for their business income.

How to get the exemption so as to keep the claim of cruelty free is a matter to many mass market brands. First of all, the beauty products sold in China are divided into 2 categories – general cosmetics and special cosmetics. General cosmetics are makeup, skincare, hair-care, nail-care, fragrances and so on. Special cosmetics are those that make functional claims, like sunscreens, anti-hair loss products, whitening products and the cosmetics claim new efficacy. Following is no exemption products according to the information in 2021, If the product is designed for baby and children or the product contains a new cosmetic ingredient, animal testing is a compulsory requirement. This category is grouped in to product group (a). For some general cosmetics but not mentioned in (a), then, the next question is whether the brand products will be sold at retailer stores in China. If the products are not sold in the mainland, China, or only sold online such as Tmall, TaoBao or JD, then the animal testing is not required compulsorily. If the products are sold at any stores but they were made inside China, pre-market animal testing is not a compulsory requirement, but post-market animal testing may be conducted. However, if the product is sold at any physical stores in China but the products were not manufactured inside China, the brand company is required to provide some document like GMP certification issued by the local government cosmetic authority and a safety assessment. Otherwise, pre-market animal testing is still required. 

For special cosmetics, If these types of products are not sold in China, animal testing is not required. If the brand company sells these types of products in China, animal testing is required whatever the products were made in China or not.

In summary, for the brands who is claimed as cruelty free out of China but being sold in the mainland China, whether the brand is truly cruelty free falls into a grey area if the brand does not share the business practice of entering into the market of mainland China.
